Welcome to Qualify, an online learning marketplace operated by Qualify, a Wyoming corporation ("Qualify," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at qualify.com and related services (collectively, the "Platform").
By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Platform.
1. Acceptance of Terms
By creating an account or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
Qualify is an online marketplace that connects instructors with students for educational courses. Our Platform allows:
- Instructors to create, upload, and sell educational courses
- Students to browse, purchase, and access educational content
- Secure payment processing and transactions
3. User Accounts and Registration
Account Creation: To use certain features, you must create an account by providing:
- Email address (required)
- Full name (required)
- Password (required)
- Country/location (required)
- Phone number (optional)
Instructor Accounts: Instructors must additionally provide tax information and complete payment account verification.
Account Security: You are responsible for maintaining the confidentiality of your account credentials.
4. Acceptable Use and Content Standards
Permitted Content: Qualify allows educational content covering all legitimate educational topics that comply with Stripe's prohibited business guidelines.
Prohibited Content: You may not post, upload, or distribute content that:
- Violates any applicable laws or regulations
- Infringes intellectual property rights
- Contains adult content, gambling, or illegal activities
- Promotes violence, discrimination, or hate speech
- Includes spam, malware, or harmful code
- Misrepresents your identity or credentials
5. Course Quality Standards
All courses must meet our quality review requirements:
- Minimum 5 lectures per course
- Minimum 30 minutes of video content for paid courses
- No time limit for free courses
- Clear audio and video quality (minimum 720p)
- Professional presentation standards
- Content must match course descriptions
Review Process:All courses undergo a 2-3 business day review process before publication.
6. Payment Terms and Revenue Sharing
Payment Processing:All payments are processed securely through our verified payment system. Instructors must maintain valid payment processing accounts.
Revenue Sharing:
- Instructors receive 70-85% of course sales (minus Stripe fees)
- Qualify retains 15-30% platform commission
- Revenue share percentages are negotiated case-by-case
Affiliate Commissions:When sales occur through approved affiliates:
- Affiliates receive 10% commission
- Affiliate commissions are deducted from Qualify's platform fee
- Instructors maintain their full revenue share percentage
7. Refund Policy
Student Refunds:Students may request refunds within 30 days of purchase, provided:
- Request is made within 30-day window
- Student has completed less than 30% of course content
- Request doesn't constitute abuse (excessive refunds, pattern violations)
Refund Processing:
- Refunds processed within 5-7 business days
- Refund costs split equally between Qualify's commission and instructor's share
- We reserve the right to deny refunds for suspected abuse
8. Intellectual Property
Course Content:Instructors retain ownership of their course content but grant Qualify a license to host, distribute, and market their courses.
Platform Content:IQualify owns all rights to the Platform design, functionality, and proprietary technology.
Student Materials:IStudents receive a personal, non-transferable license to access purchased courses.
9. Data Sharing and Privacy
Instructor Access:IWhen students purchase courses, instructors receive student names and email addresses for course delivery purposes.
Marketing Communications:We may send marketing emails only to users who have explicitly opted in.
10. Support and Communication
Student Support:Students should contact instructors first for course-related questions, then contact
support@qualify.com for platform issues.
Response Times:We respond to support requests within 48 hours, Monday-Friday, 9 AM - 5 PM Pacific Time.
11. Affiliate Program
Eligibility:Instructors may recruit affiliates subject to our approval process, which includes:
- Identity verification
- Tax documentation
- Background screening
- Compliance agreement
Requirements:Affiliates must:
- Disclose affiliate relationships in all promotions
- Comply with FTC guidelines
- Avoid misleading claims or spam practices
- Submit to ongoing monitoring
12. Termination
We may suspend or terminate accounts for violations of these Terms, at our sole discretion, with or without notice.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUALIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
14. Governing Law
These Terms are governed by the laws of Wyoming, without regard to conflict of law principles.
